Prohibition of improper use of State Emblem of India
Legal Corner Icon — the image was hosted by the publisher and was not captured.CBDT has informed all the Chief Commissioners that use of State Emblem on the cars provided to the officers of the Department is not authorized as per provisions of State Emblem of India (Prohibition of Improper Use) Act, 2005.
Some instances of violation of the provisions of Act were brought to the notice of the Finance Minister, who has taken a serious view of matter. All CCsIT are directed to ensure that the provisions of State Emblem of India (Prohibition of Improper Use) Act, 2005 are not violated by unauthorized use of State Emblem in the official cars.
Board has requested that compliance of the advisory be ensured by officers under the charge of the Chief Commissioners.
As per the Emblem of India (Prohibition of Improper Use) Act, 2005, even the Finance Minister is not entitled to display the National Emblem on his car - which privilege in India is extended only to the President, Vice-President and State Governors.
When you see some babu with the National Emblem on his car, you see an offender and not an officer of the State.
