Definitive anti-dumping duty on injection presses, having clamping force not less than 40 tonnes
CENTRAL Government has imposed definitive anti-dumping duty on import of all kinds of plastic processing or injection moulding machines, also known as injection presses, having clamping force not less than 40 tonnes, falling under Chapter 8477 10 00.
Earlier a provisional anti-dumping duty was imposed vide Notification No. dated May 12, 2009. Now based on the final findings of the designated authority which were notified on January 1, 2010 wherein a definitive anti-dumping duty was recommended, the Central Government has imposed definitive anti-dumping duty which shall be valid for a period of five years from the date of imposition of the provisional duty.
Overactive DRI?
Meanwhile in several places, DRI has booked cases and seized injection moulding machines even when they are not plastic processing machines – their interpretation is ‘the anti dumping duty is on plastic processing or injection moulding machines'. The injection moulding machines need not be plastic processing machines. If that were to be so, why should the word plastic be used at all? It can be simply all processing or injection moulding machines! But DRI sleuths are not prepared to listen to reason and all seized machinery are resting idly and importers are running from one DRI office to another to get them released.
