IN Kanhaiyalal vs. Union of India - , the Supreme Court had held that confessions made under provisions of Section 67 of the NDPS Act and other criminal enactments, such as the Customs Act, 1962, may be treated as confessions for the purpose of Section 27 of the Evidence Act.

Now another Bench of the Supreme Court has doubted Kanhaiyalal and referred the issue for consideration by a Larger Bench.
