Appeal connected papers are in Marathi - translation required
RULE 5 of the CESTAT (Procedure) Rules, 1982 is titled ‘Language of the Tribunal'. Sub-Rule (1) reads -
"(1) The language of the Tribunal shall be English;
Provided that the parties to a proceeding before the Tribunal may file documents drawn up in Hindi, if they so desire;
Provided further that a Bench may in its discretion, permit the use of Hindi in its proceedings; so however, the final order shall be in English."
In the present case, when the matter was last heard, the Bench directed the appellant to submit all the papers connected with the appeal.
The appellant obeyed the orders and submitted the papers but the papers were in Marathi language.
The Revenue representative sought a free translation of the same in English language and the Bench agreed. So, the appellant was directed to give English translation of the documents to the Revenue as well as to the Bench and the matter was listed for hearing again.
