But this extension is applicable only to Government offices; for others the due date remains 30th June. But why this special treatment for Government? Ideally, he Government should be a model in obeying the laws and should not claim any special concession. For one, the facilities available with the Government to comply with the laws are enormous. If the Government finds it difficult to meet the deadlines fixed by Law, will it not be more difficult for non-government organisations and individuals already burdened with too much of governance and complexities of laws coupled with multitude of forms and returns. Is it a tacit admission by the Board that Government is inefficient and cannot file the returns within the specified time? Or is it arrogance that Government should get away with disobedience while the citizens have to obey the laws however difficult they are? Taxes must have been deducted by 31st March 31st and what prevents the Government offices from filing the return by 30th June? If three months are not enough to file this return, will another two months help or is the time going to be further extended? If so you are in trouble. The Central Excise department has announced its special love for you. They want to know your welfare and progress on a weekly basis. And the system is already in place. You have to submit your first return by 3rd of June. Trade Notices have been issued by Commissionerates detailing the procedure and the lofty aims behind this exercise is stated to be to take prompt remedial action for the problems faced by the assessees and soon the trade notice turns authoritarian and states that major assessees SHALL submit online information on production, clearance, exports, revenue liability etc on a weekly basis. Why can’t there be a request instead of ‘shall’ and why submit? Is the assessee always expected to be submissive? Long ago there used to be a mistaken notion that the bureaucrat is a civil servant. Today he is neither civil nor a servant.

The weekly e-return is required to be filed online to the department’s website by the 3rd, 10th, 17th and 24th of the month. They are also required to fill a web form. The assessee will use the user id and password provided by the department.

Under what law is the assessee required to do all this? Don’t ask such silly questions, if you do all it takes is a notification to amend the rules and if you are adamant they will amend the rules retrospectively with effect from 1944 and make non filing of this return a cognizable offence! The moot question however is, What is the department going to do with all this information?

Source: TRADE NOTICE NO. 57 / 2005 Dated: 27.06.2005 of Chennai I Commissionerate.

In High Places – low talk

"We really slobbered over the old witch,"

"While she was a bitch, we got what we wanted too; she will not be able to go home and say that the United States didn't give her a warm reception and therefore in despair she's got to go to war."

This conversation took place in Oval Office of the White House on the morning of Nov. 5, 1971. In his meeting with Morarji Desai, Carter was not able to convince Desai about the NPT. He turned to his aide, sitting next to him and whispered, that on return home, he would send a ‘cold and blunt' communication to Mr. Desai. The `whisper', however, was carried by the sound magnifying system, installed for their speeches and heard clearly by the shocked audience. The stoic Desai did not allow this freak incident to spoil the cordial hospitality.

Until Tomorrow with more DDT

Have a nice day.

Mail your comments to vijaywrite@taxindiaonline.com
