<b>Certainly</b> not a great achievement or a great event for
us to celebrate or to boast about, but certainly an important
milestone in our long journey with faltering steps though. This
certainly gives one a little right to make a few immodest personal
remarks. Editorial columns of news papers are supposed to be so
impersonal that the first person singular is taboo. The editorial
wisdom (or the lack of it) has to be couched in third person and
indirect speech. Similarly our judicial language is also in third
person, may be because a case as his genesis in third degree methods.
It is always “the appellant/petitioner submits” never
“I/we submit”. I don’t understand why it should
be so but there should be some solemn reason. Actually I should
say, “it is not understood”, not “I don’t
understand”. Correspondence in government offices is also
of the same language. Government officers are experts in the use
of indirect speech that over the years they have lost the power
to communicate directly. This may be one of the reasons for all
the litigation and ultimately the language of litigation is also
indirect. Why can’t we talk and write simple easy language
to understand and direct speech? <br>

When Taxindiaonline started DDT, I had no clue as to how we were
going to sustain day after day of tax dosage. Almost everyday
I was sure that I would not be able to write the next day’s
DDT. Not even the best of well wishers thought the DDT can survive
more than a week. So the simple fact that DDT is 100 today gives
immense pleasure and coincidentally it falls on a day when <b>Taxindiaonline</b>
has completed five eventful years of existence. It is hard to
believe that Taxindiaonline is only five years old; for many it
is a part of life, always available with the latest. <br>

DDT is immensely grateful to the Government of India for its incessant
supply of material which has kept DDT alive. I am also indebted
to a large number of concerned netizens who have constantly supported
DDT with information, comments and suggestions. I am honoured
by congratulatory messages from kind netizens who have spared
time to send in their inspiring greetings on this occasion. DDT
is meant to inform, to analyse, and to point out errors so that
they can be corrected before irreparable damage is caused. We
will march forward with your support. <br>

As mentioned in DDT 96, the new President of CESTAT Justice Abichandani
is a prolific writer on subjects as diverse as DNA and Income
Tax but all with a touch of law. We are happy to present a special
series of articles by Justice Abichandani starting with an article
on Income Tax today. We are grateful to the Justice for permitting
us to share his profound thoughts with netizens of <b>Taxindiaonline</b>.
What is common to the Central Excise Act and the Income Tax Act?
Both the Acts do not provide a comprehensive definition of the
basic factor of taxation. Excise duty is on manufacture and income
tax is on income. But strangely the Acts give inclusive definitions
for manufacture and income. <br>
<br>
<b><font color="#006633">ASK income tax</font></b></font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"><b>ASK</b>
is for <b>Aaykar Sampark Kendra</b> – Taxpayer information
and service centre of the income tax department. The Director
of Income Tax (systems) has invited bids from reliable and reputed
call centre operators to establish these centres. The idea behind
ASK is to provide world class service to taxpayers. The grievances/concerns/complaints
of taxpayers will be addressed to a minimum level of 90% on a
daily basis. The call centre will revert to the taxpayers within
72 hours to report the status of grievances or complaints. High
standards have been envisaged like a call will be picked up in
less than three rings, the average wait time will be less than
10 seconds, average hold time will be less than 30 seconds and
E-mail reply will be sent in less than 48 hours. It is not going
to be like the other call centres. Next time you make a call to
the income tax, don’t expect a sweet sounding girlish voice
cooing in to your ears stupid by-hearted text. The service centres
are going to be ‘manned’ by highly qualified commerce
graduates with financial qualification or ICWA, CA etc., who will
be known as Tax Relationship Agents (TRA). It is IT’s date
