<b>DEPB benefits available to SEZ units even before 11.5.2004 – Board
clarifies</b></font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">
<b>BOARD</b> had Vide Circular No. 25/2003-Customs dated 1st April, 2003,
clarified that “henceforth, supplies made by DTA units to units in SEZ
would be entitled to DEPB benefits”. However the SEZ scheme came into
effect only on 11.5.2005. The Board had, therefore, issued a Circular (Circular
No. 11/2004-Cus dated 5.2.2004) clarifying that till the operation of SEZ,
the benefit of DEPB Scheme does not become legally available in respect of
supplies made by DTA units to SEZ units. Then what happens to the supplies
made during the period 1.4.2003 to 11.5.2004? Board has now clarified after
obtaining the advice of the Law Ministry that the benefit of DEPB Scheme would
be admissible in respect of supply of goods from units in DTA to units in
SEZ during the period from 01.04.2003 to 11.5.2004. So the Circular No. 11/2004-
Cus dated 5.2.2004 has been withdrawn. Thank God ands Board! A thorny issue
is settled – hopefully.<br>

<font color="#006633"><b>The 8 Digit confusion?</b></font><br>

The 8 digit Central Excise Tariff is in force from 28.2.2005 but neither the
assessee nor the departmental officer is clear on how to go about classifying
the product. Now the classification may not have any effect as the there may
not be any difference in duty rates even if you go wrong by a few chapters.
But what worries the assessees is that in many places Central Excise officers
are refusing to accept ER-1 returns if the new 8 digit tariff item is not
mentioned. To add to the confusion, the new tariff has prescribed the unit
of quantity for each item. If you were measuring your product in litres earlier
and if the Tariff now requires you to show the item in meters, you simply
have no choice. Can your friendly Central Excise Range officers help? They
are as helpless as you are! <br>

<font color="#006633"><b>Hindi Cheeni Bhai Bhai</b></font><br>
<br>
China to be India’s largest trading partner. :- Shri Kamal Nath, Minister
of Commerce and Industry, has said that China is poised to become India’s
largest trading partner in two or three years if the rapid growth in bilateral
trade seen lately is maintained. While trade between the two countries had
increased rapidly, crossing the 12 billion dollar mark this year – up
from less than 1 billion dollars a decade ago - , Shri Kamal Nath made two
suggestions for further augmenting the bilateral flow of trade and investment.
One, the composition of the export basket needs to change to make it more
broad-based in favour of higher value-added items, especially for India’s
exports in sectors like drugs and pharmaceuticals and chemicals as well as
in service sectors like information technology, tourism, banking etc. And
secondly, there should be greater focus on investment flows between India
and China.<br>

<font color="#006633"><b>Powers of DG, Excise & Customs Intelligence to
be curtailed<br>
</b></font><br>
The Board is likely to recommend a proposal to restrict the powers of directorate
general of intelligence by limiting its jurisdiction only to intelligence,
a senior official said. <br>
<br>
The Official said that the Board in its meeting lately agreed in principle
to change the mandate of the DG (Customs and Excise) by taking back large
extent the enforcement powers of the directorate and assign it actual duties
that are to recommend measures to the government for minimizing the quantum
of the smuggling into country by information collected by its field formations.
<br>
<br>
The new role of the directorate would also include the liaison with the international
anti-smuggling organizations to curb the smuggling of goods as well as the
prohibited items under international law. <br>
<br>
The Official said that by the new role, the directorate would not be authorized
to permit its officers to check the non duty paid vehicles, raid the business
premises and checking of imported cargoes at any place in the country.<br>
<br>
The operations of the directorate would be to maintain the data bank of the
routes of smuggling, smugglers and items that are being smuggled in the country
and check the working of the officials and officers of all taxes so that the
element of the corruption could be stopped with the help of officials. <br>
<br>
<b>It was a long-standing demand of the business community to check the activities
of the officials of the directorate and save the community from the undue
harassment caused by the officials of the directorate by indulging in unnecessary
inspections and raids, especially outside the international ports, airports
and dry port, the official said. </b><br>
<br>
The directorate would be allowed to exercise minimum enforcement powers that
would not create difficulty for the business community, the official added.<br>
<br>
