<html> <head> <title>Untitled Document</title> <meta http-equiv="Content-Type" content="text/html; charset=iso-8859-1"> </head> <body bgcolor="#FFFFFF"> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"><b><font color="#0000FF" size="3">TIOL-DDT 81</font><br> 24 03 2005<br> Thursday</b></font></p> <p align="center"><font color="#009933" size="2" face="Verdana, Arial, Helvetica, sans-serif"> <b>What is the fate of ITC ordinance?</b></font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">As is well known, the ITC ordinance was issued on 25th January 2005. The ordinance was issued under Article 123 of the Constitution, which reads as,<br> <br> <b>123. Power of President to promulgate Ordinances during recess of Parliament.</b>—(1) If at any time, except when both Houses of Parliament are in session, the President is satisfied that circumstances exist which render it necessary for him to take immediate action, he may promulgate such Ordinances as the circumstances appear to him to require.<br> <br> (2) An Ordinance promulgated under this article shall have the same force and effect as an Act of Parliament, but every such Ordinance—<br> <br> (a) shall be laid before both Houses of Parliament and <b>shall cease to operate at the expiration of six weeks from the reassembly of Parliament, or, if before the expiration of that period resolutions disapproving it are passed by both Houses, upon the passing of the second of those resolutions; and</b><br> <br> (b) may be withdrawn at any time by the President.<br> <br> So, as per the Constitution, the ordinance lapses after six weeks of the Parliament session starting. This is to happen on April 8th, but Parliament is to have a recess from tomorrow. If the ordinance does not become law today, it lapses. Both ITC and North Block are tight-lipped about the ordinance which may lapse. ITC has not paid up as a consequence of the ordinance and North Block seems to have some secret plan to be unveiled today. <b>Taxindiaonline</b> was the first to bring the ordinance to the notice of the country, but this time around we have no clue what the Government is up to. <b>It’s an interesting day ahead!</b><br> <br> <font color="#009933"><b>Advance Licence and EPCG Schemes – No surety for bonds</b></font><br> <br> Board clarifies that in the case of imports by Star Export Houses, Public Sector Undertakings etc. under Advance Licence and EPCG Schemes, the intention is not to take a Surety along with Bond. Therefore, a Bond without Surety shall be accepted. <br> <a href="http://www.taxindiaonline.com/RC2/subCatDesc.php3?subCatDisp_Id=25&filename=notification/custom/2005/cuscir05_020.htm">CBEC CIRCULAR NO. 20 /2005-Cus, Dated : March 22, 2005</a><br> <br> <b><font color="#009933">Grant of Star Status Certificate – Last date extended</font></b><br> <br> The last date for filing of application for grant of Star Status Certificate has been prescribed as 1st of March. Considering representations, the DGFT has been kind enough to extend the last date to 31st March 2005. When is this circular of the DGFT going to reach the concerned persons and when are they going to apply? There are hardly four working days left for the last date so generously extended by DGFT. <br> <br> <a href="http://www.taxindiaonline.com/RC2/subCatDesc.php3?subCatDisp_Id=46&filename=notification/dgft/2004/dgft04cir024.htm">DGFT POLICY CIRCULAR NO. 24/2004-09, Dated: March 22, 2005 </a></font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"><b><font color="#009933">Politicians – please leave education alone</font></b><br> <br> Our politicians believe they are the repositories of all knowledge and can interfere in all spheres of life. The supposed saffronisation and now detoxification of education by successive governments are causing a great amount of damage to our premier educational institutions. The Government has a constitutional obligation to ensure compulsory free primary education, in which it has miserably failed. If they cannot improve standards, they can certainly cause damages to reputed institutions. If Dr. Joshi wanted to tinker with IIMs, can his successor, Arjun Singh be left far behind? Our Regional Engineering Colleges have been citadels of high quality education, next only to the IITs. All the RECs have been recently converted into National Institutes of Technology fully funded by the Central Government. And what does the Honourable HRD Minister do immediately after taking over these institutes of excellence? Sack 11 heads of these high class institutes! He must be having a good reason to do so. They must have been appointed by his saffron predecessor and so are not good enough! Suddenly 11 NITs are headless! If this is the way the RECs are going to become the NITs – God only can save education in this country. It is unfortunate that such things can happen in a country in which the President and Prime Minister are eminent academicians!<br> <br> Why is DDT interested in this?
