to accept tax payments beyond banking hours on March 31</span></font></b></font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">The RBI has announced in a press release yesterday that:-</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">1. For the convenience of taxpayers,
the Reserve Bank of India has made special arrangements at its Mumbai and Navi Mumbai offices to receive cash deposits representing
taxes at the counters upto 4.00 p.m. on March 31,
2007. Cheques/other instruments representing payment of taxes to the Government
would be received upto 5.00 p.m. on March 31, 2007.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">2.
Instructions have also been issued to agency banks, viz., State Bank of <st1:country-region
w:st="on"><st1:place w:st="on">India</st1:place></st1:country-region> and its
associates, public sector banks and designated private sector banks to receive
taxes beyond normal banking hours on March 31, 2007. </span></font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">The
Reserve Bank has requested taxpayers to take advantage of these facilities
provided for the financial year ending March 31, 2007.</font></p>

<p align=center><font color="#006600" size="2" face="Verdana, Arial, Helvetica, sans-serif"><b>Chennai
IV Commissionerate wants duty to be paid by 30<sup>th</sup> March 2007</b></font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">The Chennai IV Commissioners instructions state that:-</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">1.
The Central Excise duty liability of assessees (both SSI and Non-SSI)
for March-07/quarter ending March-07 should be discharged by 30 th March 2007.
The assesses have also been exhorted to utilize the E-payment facility, as
far as possible. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">2. Necessary instructions may please
be issued to the field formations to ensure that the assesses
discharge the liability for March-07 by 30.3.2007. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">3. The telegraphic summary on the
provisional revenue realized for March 2007 must be intimated to the Statistics
Sections, Hqrs. through fax (no. 24348396) by 12.00
noon on 31.3.2007 positively. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">4. The Officers of the
Divisions/Ranges connected with the work pertaining to compiling the revenue
figures shall be instructed to be in Office on 31.3.2007 for obtaining the
revenue details from the assesses and for correct compilation . </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">5.
Care
should be taken to ensure that the revenue figures to be furnished to the
Commissionerate are accurate to the extent possible.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">As
per Rule 8 of the Central Excise Rules, </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"> (1) The duty on the goods removed from the
factory or the warehouse during a month shall be paid by the 5th day of the
following month:</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">Provided
that
in case of goods removed during the month of March, the duty shall be paid by
the <b>31st day of March:</b></font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">When the Rule stipulates that duty has to be paid by 31<sup>st</sup>, what is the
Commissioner's authority in prescribing the duty payment by 30<sup>th</sup>? </font></p>

discharge your duty liability by 31<sup>st</sup> March 2007</b></font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">The department is a bundle of contradictions! The
same Commissioner by Trade Notice No. 05/2007 dated 10.3.2007, clarified that </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">It
is learnt that some of the banks may not be offering their services from 27th
to 30th march 2007 and 31st March 2007. You may advise the assessees of your
association to keep this eventuality in mind and make suitable arrangements to
ensure that Central Excise duty liabilities for the month of March 2007 are
discharged <b>on or before 31.3.07.</b></font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">If the Commissioner is not sure when the duty is to be
paid, what can the hapless assessee do? If the department cannot assist the
assessee, the least that is expected from them is that they do not confuse the
assessees with contradictory instructions. </font></p>

course maykindly be conducted on holidaysand out of Office hours.</font></p>

infrastructure or resources for such a programme. However we will be conducting
workshops with participation from senior officers and eminent consultants in a
few places. The first of such programmes is slated to be held
in Vizag on 7<sup>th</sup> April 2007. </font></p>
