filing of excise returns</strong></font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">Ahmedabad Central Excise Commissioner has clarified that ER1, ER2 and ER3
returns filed online can be corrected if necessary.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">The assessee, who wants to cancel their return and re file the same, has to
request the jurisdictional Assistant Commissioner in writing giving the detailed
reasons for cancellation of the return. They have to mention the Location Code,
ECC Code and period of the return. A copy of such letter may also be given
to the jurisdictional Range Superintendent. After receipt of such letter and
after confirming the genuineness of the letter, the jurisdictional Assistant
Commissioner will cancel the said return and he will intimate the assessee
the fact of cancellation of the return via fax / e-mail.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">Now, the assessee can re-file the cancelled return.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">The Commissioner requests the trade take advantages of this facility of e-filing.</font></p>

<b>ITAT – work allocation among DRs – performance to be monitored</b></font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">The
CBDT has issued instructions on the work allocations for DRs before the ITAT.
CIT(DRs) will argue the following cases:- </font></p>
<blockquote>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">
(i) All appeals relating to core cases of Search/Block assessment and such
other cases of search, as are assigned by the CCIT.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">
(ii) All appeals referred to a Special Bench or Third Member Bench of ITAT.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">
(iii) All appeals filed against order passed under sec 263.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">
(iv) All appeals in which the aggregate of the additions made by the A.O.
in case is more than;</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">
a) Rs.2 crore in the cities of Mumbai and Delhi.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">
b) Rs. 1 crore in the cities of Chennai, Kolkata, Ahmedabad, Hyderabad, Bangalore
and Pune and,</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">
c) Rs. 50 lakhs in other cities."</font></p>

(v) All Scam related cases.</font></p>

The Sr DRs will argue all other cases not covered above.<br>

The CIT(DRs) and Sr. DRs would also submit a Monthly performance report on the
cases/category of cases represented by them before the Bench. The proforma for
the report is not yet ready and will be intimated shortly.<br>
<br>
It is nice to monitor the performance of the DRs in the Tribunals but do the
Boards bother to do a small check before somebody is posted as a DR. Arguing
a case before the Tribunals is a specialized job and not every officer can do
it. For the Boards, it is another routine posting and most often a punishment
posting. In spite of lack of basic facilities, the DRs pitched against the best
legal brains are doing a commendable job.</font></p>

Journalism is under great tension. In our anxiety to report fast and first,
there is hardly any time for a recheck. In reporting the news of Sanjay
Dutt’s
TADA case, the Punjabnewsline reported that Sanjay Gandhi is acquitted. You

This is not meant to slight the newsline but only to point out that such
things do happen. The Printer’s devil is the nightmare of any journalist.
It once created a diplomatic crisis when the German Crown Prince visited
England in the 19th century. The London Times carried on its front page
the headline: 'Visit of German Clown Prince.' The outraged German Ambassador
demanded an immediate apology and a correction. The next day The London
Times published: "We
regret the error in the report of the German Crow Prince". Obviously the
printer's devil was at work again but the German Ambassador wisely thought
it best not to ask for another apology and a correction.</font></p>

Lost in the maze of Sanjay Dutt news was the conviction of a Customs Additional
Commissioner in the blast case.</font></p>
