<html> <head> <meta http-equiv=Content-Type content="text/html; charset=windows-1252"> <title>Taxindiaonline's DDT 402</title> </head> <body> <p align="justify"><b><font color="#663399" size="3" face="Verdana, Arial, Helvetica, sans-serif">TIOL-DDT 496</font></b><font size="2" face="Verdana, Arial, Helvetica, sans-serif"><b><br> 22 11 2006<br> Wednesday</b></font></p> <p align=center><font size="2" face="Verdana, Arial, Helvetica, sans-serif"><b><font color="#006600">Goods for ‘Airborne Early Warning and Control (AEW&C) System’ exempted from customs duty</font></b></font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">Aircrafts and their parts, aircraft engines and their parts, radars, machinery,equipment, computer hardware and software, accessories and consumables etc, required for the Airborne Early Warning and Control (AEW&C) System Programme of Ministry of Defence are exempted subject to the conditions that - </font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">1. the goods are imported by authorised works centers of the Airborne Early Warning and Control (AEW&C) programme, and</font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">2. authorised works centre produces to the JC/DC/AC of Customs, at the time of import, in each case, a list of the said goods with their relevant description duly certified by the Programme Director, to the effect that -</font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">i) the said goods mentioned in the list are required for the purposes of the AEW&C;</font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">ii) the import of the said goods mentioned in the list are authorized by the Ministry of Defence under AEW&Cprogramme and the said goods shall be used only for the purpose of the AEW&Cprogramme.</font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">This notification will expire on 1.1.2012</font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"><a href="http://www.taxindiaonline.com/RC2/subCatDesc.php3?subCatDisp_Id=23&filename=notification/custom/2006/ctariff06_113.htm">NOTIFICATION No. 113/2006-Cus., Dated: November 16, 2006</a></font></p> <p align=center><font size="2" face="Verdana, Arial, Helvetica, sans-serif"><strong><font color="#006600">SSI</font></strong><font color="#006600"><strong> exemption – Bar of brand name not to apply to note books, writing pads </strong></font></font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">As per para 4 of Notification No. 8/2003, </font></p> <p align="justify"><font color="#663399" size="2" face="Verdana, Arial, Helvetica, sans-serif">The exemption contained in this notification shall not apply to specified goods bearing a brand name or trade name, whether registered or not, of another person, except in certain cases like: -</font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">(a) where the specified goods, being in the nature of components or parts of any machinery or equipment or appliances, are cleared for use as original equipment</font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">(b) where the specified goods bear a brand name or trade name of Khadi and Village Industries Commission, State Khadi and Village Industry Board etc,.</font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">(c) where the specified goods are manufactured in a factory located in a rural area.</font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">To the above three cases another is added now</font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">(d) where the specified goods are account books, registers, writing pads and file folders falling under heading 4820 or 4821. </font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">So now branded notebooks can be manufactured by SSI units and still be eligible for the exemption.</font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"><a href="http://www.taxindiaonline.com/RC2/subCatDesc.php3?subCatDisp_Id=30&filename=notification/excise/2006/etariff06_045.htm">NOTIFICATION No.45/2006-CX.,Dated : November 20, 2006</a></font></p> <p align=center><font size="2" face="Verdana, Arial, Helvetica, sans-serif"><strong><font color="#006600">Unconditional free import of 6 - APA</font></strong></font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">DGFT has allowed unconditional free import of 6-APA. Hitherto there was a condition that <font color="#663399">“imports are permitted subject to Registration and other requirements as administered by Drug Controller General of India under the provisions of Drugs and Cosmetics Act.”.</font> This condition is now deleted. </font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">6-APA finds a place in the Customs Tariff against SH 2941 10 50 under <i>Antibiotics - Penicillins and their derivative with a penicillanic acid structure; salts thereof. </i></font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">APA stands for Amino Penicillanic Acid; the molecular formula is C8H12N2O3S. It is used for the production of semisyntheticpenicillins.The first 6-APA plant was established in India by IDPL in 1981 in technical collaboration with <st1:City>Farmfin</st1:City>, Italy.</font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">Ampicillin was first discovered in 1961. However it was only in 1965, the first commercial process was developed. Penicillin, the first antibiotic, was discovered in 1929. In 1940, a commercial process for its manufacture was developed. Its shortcomings, like its narrow range of spectrum, resistance developed pathogenic bacteria, allergic side reactions, soon became apparent. 6-APA, the central molecule of penicillin was first isolated in 1950. It was in 1959 that a viable process for its manufacture was developed. It was also discovered that by substituting the side chain of penicillin by amino group, its effectiveness against gram negative bacteria is substantially enhanced. It was then, that ampicillin was discovered. Later on more such semi synthetic Penicillins, like amoxycillin, have been discovered. In 1965 the first commercial process, using Dane's Salt, was established. Initially the efficiencies were low. In 1973 the acid chloride process was established. Soluble enzymes were used for the manufacture of 6-APA. Efficiency was low and the production cost was high. Later, a chemical process was developed. It was sturdier and more efficient. However, it required handling of many hazardous chemicals. </font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"><a href="http://www.taxindiaonline.com/RC2/subCatDesc.php3?subCatDisp_Id=45&filename=notification/dgft/2006/dgft06not036.htm">DGFT NOTIFICATION No.36,(RE-2006)/2004-2009, Dated: November 21, 2006 </a></font></p> <p align=center><font color="#006600" size="2" face="Verdana, Arial, Helvetica, sans-serif"><strong>Procedure for import of </strong><b>Vegetable Fats, Pepper and Desiccated Coconut under Indo-Sri Lanka Free Trade Agreement – DGFT prescribes</b></font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"><b>vanaspati including bakery shortening and margarine – </b>Total quantity of imports will be restricted to 2.5 lakh MT per annum subject to the following conditions:-</font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">a) The quantum of imports of Vanaspati, Bakery Shortening and Margarine for the year 2006-07 will be arrived at by deducting the import of this item already made from Sri Lanka under the Agreement till the date of issue of this Public Notice.</font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">b) application for imports to be made to their Exim Facilitation Committee in the AayaatNiryaat Form.</font></p> <p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">c) All applications must accompany a pre-purchase agreement from one of the eligible exporter of vanaspati in Sri Lanka. Indian shrimp exporters are forced to take out a customs bond equal to about a year's worth of duties.
