REPORTS REDUCTION OF 11243 MT OF CFC – customs officers to be trained</b></font></font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"><img src="http://www.taxindiaonline.com/RC2/image/guest/kumar_vijay_eic.jpg" width="60" height="75" border="1" align="left">India
is operated under Article 5, paragraph 1 of the Protocol (developing country
with per capita consumption of Annex A substances less than 300 gms.) and eligible
for financial and technical assistance from the Multilateral Fund of the Montreal
Protocol to phase-out production and consumption of Ozone Depleting Substances
(ODSs) as per the controlled schedule in the Protocol. India produces CFC-11,
CFC-12, CFC-113, Halon-1211, Halon-1301, Carbon Tetra Chloride (CTC), methyl-chloroform
and methyl bromide. These ODSs are used in refrigeration and air conditioning,
fire fighting, electronics, foams and aerosol industries.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">India has
taken a series of fiscal and regulatory measures to facilitate ODS phase-out
in the country. Among fiscal measures taken, the Government of India has accorded
<b>customs and excise duty exemptions on goods required for ODS phase-out projects
and new investment with non ODS technology</b>. The Reserve Bank of India has
issued directions to all financial institutions and commercial banks not to
finance new establishment with ODS technology. Trade in ODS with non-Parties
to the Protocol has been banned. All ODS have brought under the ambit of licensing
for purpose of both imports and exports. Export of CFCs to Non-Article 5 Countries
has also been banned.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"><b>A national
training programme for customs and enforcement officials and national awareness
programme are under implementation. </b>The Executive Committee has approved
a funding for preparation of CFC phase-out in Metered –Dose-Inhalers (MDIs)
sub-sector and HCFC strategy for India.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">India has
so far met the following compliance dates as per the control schedule of the
Montreal Protocol: -</font></p>
<blockquote>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">(a)
Freeze of CFC production and consumption in July, 1999 at 22588 ODP tons and
6681 ODP tons respectively.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">(b)
Freeze of Halon production and consumption on 1.1.2002.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">(c)
Total phase-out of halon production and consumption.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">(d)
50% reduction of CFC production and consumption in 2005 (production from 22588
MT to 11240 MT and consumption from 68812 MT to 1640 MT).</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">(e)
85% reduction of CTC production and consumption (production from 11525 MT
to 1508 MT and consumption from 11537 MT to 1493 MT.</font></p>

<p align=center><font size="2" face="Verdana, Arial, Helvetica, sans-serif"><strong><font color="#006600">DELISTING
OF SECURITIES – DRAFT RULES COMMENTS INVITED</font></strong></font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">The Finance
Ministry proposes to amend the Securities Contracts (Regulation) Rules, 1957
(SCRR) to provide for the grounds for delisting, while the manner of delisting
and the procedural details would be provided in the Regulations to be made by
SEBI under the Act.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">Comments

Act – </font></strong><font color="#006600"><b>Soli Sorabji Committee - <strong>Report
submitted</strong></b></font></font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">The Committee
set up to draft a new Police Act to replace the Police Act of 1861 submitted
its report to the Home Minister, The chairman of the Committee, Soli Sorabji
said that the Committee has kept it in mind that police has to be given a people-friendly
face.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">The terms
of reference of the Committee were:-</font></p>
<blockquote>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">(a)
To examine the Model Police Act prepared by National Police Commission and
other draft Model Police Acts and suggest modifications as per the changing
role/responsibility of police in view of the new challenges before it, especially
growth and spread of insurgency/militancy/naxalism, etc.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">(b)
To suggest measures for attitudinal changes of police including working methodology,
to elicit cooperation and assistance of the community rather than its distrust.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">(c)
The new Police Act should reflect expectation of the people regarding the
police in a democratic setup.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">(d)
It should emphasise the use of scientific investigation methods to strengthen
the criminal justice system. It should enable the police to tackle futuristic
trends of organized crime including cyber crimes and technological advantages
in the hands of the criminals.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">(e)
The concerns for human rights, weaker sections, women and the people belonging
to scheduled castes/scheduled tribes have to be addressed. </font></p>
</blockquote>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">The report
contains 16 chapters and 114 pages and includes a model Police Act in 221 sections.

<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">CBI director
Vijay Shanker is reported to have said, "The judgment of the Delhi High
Court will set a benchmark for trial courts and also investigating agencies
to introspect their functioning and bring about overall improvement." </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">The whole
country seems to be happy with the judgement. The two recent death sentences
have created so much noise in the country with politicians and social activists
joining the fray and news channels and the press fanning the fire of death penalty.
Why is the public interested so much in the noose? And can’t this high voltage
publicity be cited by the accused/convict as an unfair trial?</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">While delivering
the Afzal judgement the Supreme Court observed, </font></p>
<blockquote>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">"The
incident, which resulted in heavy casualties, had shaken the entire nation,
and the collective conscience of the society will only be satisfied if capital
punishment is awarded to the offender. The challenge to the unity, integrity
and sovereignty of India by these acts of terrorists and conspirators can
only be compensated by giving maximum punishment to the person who is <i>proved
to be</i> the conspirator in this treacherous act"</font></p>
</blockquote>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">The appellant,
who is a surrendered militant and who was bent upon repeating the acts of treason
against the nation, is a menace to the society and his life should become extinct."</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">And in the
Mattoo case, the High Court observed,</font></p>
<blockquote>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">“We
are thus of the opinion that for a crime of this sort which has been committed
with premeditation and in a brutal manner, the convict deserves no other sentence
but death,”</font></p>
</blockquote>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">But is killing
a criminal a good enough punishment? Doesn’t killing end all his problems? Does
death act as a deterrent? Many people will be happy to die rather than spend
the rest of their lives inside a prison. So the death penalty may be after all
a reward and not a punishment. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">Recently
Khushwant Singh suggested that instead of death sentence, “Let him languish
in a high security prison for the rest of his life and let him do something
constructive like teaching children and cleaning latrines morning and evening.”</font></p>
<p align="justify"><font color="#FF6666" size="2" face="Verdana, Arial, Helvetica, sans-serif">Until
