The Finance Minister was assured that the State administration will ensure availability of the Forms accordingly and the EC will closely monitor the matter.

Government of India had amended the Central Sales Tax (Registration & Turnover) Rules, 1957, through Notification No. GSR 588(E), dated 16 Sept. 2005, providing for submission of Form C in respect of inter-State sale transactions on quarterly basis instead of annual basis. The amendment was carried out by the Government on the recommendation of the Empowered Committee of State Finance Ministers, who felt that this was required for close monitoring of inter-state sale transactions. However, trade and industry has been making representations opposing this amendment, mainly due to difficulties in getting C Forms. With States’ assurance it is expected that the new system of quarterly filing of C Forms will stabilize shortly.

Service tax - Nokia asked to pay for consultancy work abroad

It was not Nokia’s day at the Tribunal. Unable to pay the duty the contractors have called it a day and it look like there are no pipes and no water and of course no excise! The dispute is about the stages in the pipeline. While Central Excise department wants to give exemption to only the first of the four stages, the Water Board maintains that there is only one continuous lift and there are no distribution points mid way. The problem has to be sorted out immediately as this cannot wait for four to five years of adjudication, appeal etc,.

Greek and Latin - DDT's new feature

Often used in judgements to refer to a judgement already cited.

“the Legislature intervened and amended the provisions of Section 11A of the Act by Finance Act, 2000 with retrospective effect to take away the effect of the judgment of this Court in Cotspun Limited’s case (supra)”

“In this case, as set out hereinabove, all facts were within the knowledge of the Department.
