<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"><strong>FINANCE</strong> Minister Arun Jaitley met the representatives of Industry and Trade Groups yesterday as part of his pre-budget consultations. He told the businessmen about his commitment towards implementation of the 7th Pay Commission Recommendations in the coming financial year. He has to find an additional one lakh crore rupees for that. Service Tax and Excise Duty will certainly go up. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">India Inc suggested to him to implement the Pay Commission Recommendations in staggered manner. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">Other suggestions: </font></p>
<blockquote>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">1. Minimum Alternate Tax (MAT) may be withdrawn in calibrated manner; </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">2. tax exemptions and allowances be withdrawn while tax rate may be rationalised in order to bring transparency; </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">3. certainty and less discretion to make the tax administration more transparent and efficient; </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">4. Tax incentives be given for use of debit and credit card; </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">5. payment of utilities be made mandatory by cheques or through e-payment; </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif" style="background-color:#FFFF00" span="span">6. clarity of policies by CBEC & CBDT to its field offices to avoid any discrepancies and discretions in tax administration; </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"style="background-color:#CCCCCC" span="span">7. implementation of GST at the earliest. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">8. Service tax should be paid by contractors to government, only when they receive the payment from the government (this could be deducted from the government's payment). Today, contractors don't have the margin to deposit service tax every month yet receive their payments after many months. If there's a default receiving payment, then the service tax on that default should be credited back into the account of the payee. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">9. Eliminate all surcharges on corporation tax, service tax, etc. This does not promote ease of doing business, when everyone has to calculate taxes to two decimal places. Adjust tax rates where necessary. </font></p>
</blockquote>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">Nothing serious happens in these meetings. See the Captains of Industry have asked the Finance Minister to implement GST at the earliest. That is exactly what he has been trying to do for the last one year with hardly any headway. What can he do in this regard in the budget? </font></p>
<p align="center"><font color="#006600" size="3" face="Georgia, Times New Roman, Times, serif"><strong><em>Missing IRS Officers Treated as Resigned </em></strong></font></p>
<p align="justify"><strong><font size="2" face="Verdana, Arial, Helvetica, sans-serif">FROM <a href="http://www.taxindiaonline.com/RC2/NewsDesc.php?MpoQSrPnM=MjQ4MTI=" target="_blank">DDT 2695 30 09 2015</a> </font></strong></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif" style="background-color:#EDCCCB" span="span"><strong>MORE</strong> than four years ago in <a href="http://www.taxindiaonline.com/RC2/NewsDesc.php?MpoQSrPnM=MTIzNzQ=" target="_blank"><strong>DDT 1588 13.04.2011</strong></a>, I reported that <em>CBEC has circulated a list of 27 IRS(C&CE) officers who have been unauthorisedly absent from duty for a long time. It has not been possible to take necessary action against these officers for want of their present address(es). The list contains, inter-alia, the last known posting of these officers</em>. The list was obviously wrong as I met one of the ‘missing' officers in her office a few days later. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"style="background-color:#EDCCCB" span="span">Last year, the CBEC circulated a list of 19 missing IRS officers (<strong><a href="http://www.taxindiaonline.com/RC2/NewsDesc.php?MpoQSrPnM=MjA3ODk=" target="_blank">DDT 2386 01.07.2014</a></strong>). Maybe they found 8 of those missing offices in the three years.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"style="background-color:#EDCCCB" span="span">Yesterday the Board sent a letter to all the Chief Commissioners that 14 IRS officers are unauthorizedly absent from duty for a long time. So, maybe they found five more missing IRS officers. The date of birth of one of the missing officers is 16.12.1954. He would have retired on 31.12.2014; what is the use of finding him now? </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"style="background-color:#EDCCCB" span="span">Board wants the Chief Commissioners to provide information on the missing officers by 9th October. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"style="background-color:#EDCCCB" span="span">In these days of satellite communication, is it difficult to find people? Normally missing Government officers are either abroad or hiding in India. It shouldn't be difficult to trace them and if you really don't want them, just leave them alone and treat them as dismissed from service after a due notice in the newspapers. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">Now the Board has finally decided to treat these absconding officers as having resigned from service. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">The officers are:</font></p>

<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">4. Rajyashri S. Waghray - IRS 1990, Deputy Commissioner absconding from duty unauthorizedly since 11.07.2001. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">5. Bujimalla Venkata Ramesh - IRS 1994, Deputy Commissioner absconding from duty unauthorizedly since 09.08.2005. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">6. Ankur Agarwal - IRS 1995, Deputy Commissioner absconding from duty unauthorizedly since 06.04.2007. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">7. D.K. Dhawan - IRS 1995, Deputy Commissioner absconding from duty unauthorizedly since 24.06.2000. </font></p>

<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">11. Sandeep Ahuja- IRS 1991, Additional Commissioner absconding from duty unauthorizedly since 12.09.2007. </font></p>

<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">It seems that in spite of several attempts to contact these delinquent officers, there was no response from them. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">The President of India has given his consent to treat continuous absence of these officers as deemed resignation from the Indian Revenue Service with effect from the respective date when each of them went missing. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">They are not entitled for any retirement benefits. Obviously, they are not bothered about these benefits. But should somebody who has absconded be let off like this? </font></p>

<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"><strong>GOVERNMENT</strong> has issued new instructions restricting the travel of babus abroad: </font></p>

<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">1. In respect of objectives that can be achieved through exchange of letters,
tele/video conferencing or representation from our Missions abroad, no foreign
visit need be undertaken. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">2. Officers of appropriate functional level dealing with the subject are sponsored/ deputed instead of those at higher levels. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">3. Foreign visits shall not exceed 05 working days. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">4. No officer shall undertake more than 04 official visits abroad in a year. </font></p>
