loses to Sweden in the WCO elections</strong> </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"><img src="http://www.taxindiaonline.com/RC2/image/guest/satpathy.gif" alt="Mr. Satpathy" width="67" height="82" align="left">Mr
Chittaranjan Satpathy, Member, CESTAT lost the election for the post of Director
in the World Customs Organisation. Mr Satpathy was a hot favourite among the
six candidates but finally lost to Lars Karlsson of Sweden in the final round.
The Revenue Secretary and the CBEC Chairman are currently in Brussels, but were
obviously not successful in canvassing enough votes for Mr. Satpathy. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">Five
years ago, we put up a very unfortunate performance in the WCO elections when
the Government of India did not extend all out support to its own candidate,
Mr. A.M. Prasad. Mr. Prasad was not allowed to go to Brussels and finally he
went there at his own cost. The Government even asked him to pay for the brochure
he prepared to canvass his candidature. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">This
time around fortunately things were much better, but not good enough to get
our candidate through.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif"><img src="http://www.taxindiaonline.com/RC2/image/guest/lars_karlson.gif" alt="Lars Karlsson" width="63" height="84" align="left">The
five-year post is seen as crucial to the development agenda and to greater trade
facilitation in the developing and developed countries.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">Mr.
Lars Karlsson is at present Assistant Deputy Director General of Swedish Customs,
Sweden and his success can be attributed to better canvassing methodology, including
the help of Information Technology. It is learnt that he had put up his own
website to answer the queries of potential voters and he did succeed in winning
a hearts.</font></p>

to hold 2006 IT Conference & Exhibition in India</font></strong></font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">Mr.
Michel Danet, WCO Secretary General, and Mr K.M. Chandrasekhar, Revenue Secretary,
Government of India, announced yesterday in Brussels that the 2006 WCO IT Conference
& Exhibition will be held from 6-8 April 2006 at the Taj Residency Hotel
in Bangalore, India. The theme for the event "Outsourcing and Off-Shoring
- Solution for Customs?" will address strategic, legal and technical issues
related to this topic. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">India
in general and Bangalore in particular, is one of the leading IT centres worldwide
specializing in outsourcing. Outsourcing has become a strategic option also
for Customs administrations, enabling them to concentrate on their core functions,
while staying abreast of the latest technological developments. </font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">The
Conference is being organized by the WCO in close co-operation with the Indian
Customs administration and will provide participants with the opportunity to
get insight into the latest developments in the Customs and business worlds
and discuss the many challenges and opportunities.</font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">The
parallel Exhibition will offer networking opportunities, enabling participants

rates announced for imported goods and export goods</strong></font></p>

dated, June 27, 2005 fix the exchange rates for imports and exports respectively
with effect from 1st April, 2005. <a href="http://www.taxindiaonline.com/RC2/subCatDesc.php3?subCatDisp_Id=24&filename=notification/custom/2005/cnt05_041.htm">Notifications
41</a> and <a href="http://www.taxindiaonline.com/RC2/subCatDesc.php3?subCatDisp_Id=24&filename=notification/custom/2005/cnt05_042.htm">42/2005-Cus.
(N.T.)</a>, dated 26-05-2005 are superseded.</font></p>
<p align="center"><font color="#006633" size="2" face="Verdana, Arial, Helvetica, sans-serif"><strong>Chemical
Weapons Convention – Re- assignment of 8 digit codes.</strong></font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">DGFT
clarifies that the Government has re assigned 8 digit of ITC(HS) Codes to the
Scheduled Chemicals of CWC and notified them in the Customs Tariff. It is reiterated
that export of these chemicals will be allowed only after due consideration
by DGFT(hqrs) and imports are free except from the countries who have not signed
the convention or who have not notified the chemical weapons.</font></p>

of drugs under the Advance Licensing Scheme</font></strong>.</font></p>
<p><font size="2" face="Verdana, Arial, Helvetica, sans-serif">DGFT clarifies
that </font></p>
<ol>
<li><font size="2" face="Verdana, Arial, Helvetica, sans-serif">where Advance
Licence holders are exporting the goods which are manufactured from the raw
materials procured from local sources, then they are not allowed to import
from unregistered sources.</font></li>
<li><font size="2" face="Verdana, Arial, Helvetica, sans-serif"> In case exporters
intend to procure the material either from registered sources or from local
sources through ARO and Invalidation then the exemption facility given on
the Advance Licences for importing from unregistered sources may be withdrawn
and shall be modified to import from registered sources only.</font></li>
<li><font size="2" face="Verdana, Arial, Helvetica, sans-serif">Once the imports
are from registered sources, conditions governing normal Advance Licences
are applicable in these cases-which include normal validity period and normal
EO period.</font></li>
<li><font size="2" face="Verdana, Arial, Helvetica, sans-serif">In any case
if the material is imported from unregistered sources and the licence holder
has failed to export the goods, then the Advance Licences cannot be regularised
on payment of applicable customs duties etc.</font></li>
<li><font size="2" face="Verdana, Arial, Helvetica, sans-serif">Since the material
is not to be allowed for consumption within India, the unregistered material
may be allowed to be re-exported within valid Export Obligation period to
the satisfaction of customs authorities that the material which was imported
earlier is the same material that is being re-exported.</font></li>
<li><font size="2" face="Verdana, Arial, Helvetica, sans-serif">unregistered
raw material under any circumstances is not allowed to be consumed within
India.</font></li>
<li><font size="2" face="Verdana, Arial, Helvetica, sans-serif">If the goods
are re-exported then the advance licence obligations are deemed to have been
discharged to that extent.</font></li>
<li><font size="2" face="Verdana, Arial, Helvetica, sans-serif">If the EO period
is not valid at the time of re-export then party need to pay necessary composition
fee for extension of EO period if permitted under policy and procedure.<br>

sale of books</strong></font></p>
<p align="justify"><font size="2" face="Verdana, Arial, Helvetica, sans-serif">As
per para 6.8(a) of the Foreign Trade Policy, items like motor cars, alcoholic
liquors, books and tea are not allowed DTA clearances from EOUs at concessional
rates of duty. Now books are deleted from the list which means that books can
be cleared to DTA at concessional rate. But there is a catch. If the basic duty
and CVD is nil, goods cleared from EOU are considered non excisable, but now
the DGFT notification says this provision will not apply to books. Why? May
be CBEC will give a clarification.</font></p>
